Terms of Service

1. Acceptance of Terms
By accessing or using Trending Music — the iOS application and the marketing website at trending.fm (together, the “Service”) — you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you are at least 13. If you are under 18, you represent that your legal guardian has reviewed and agreed to these Terms.
3. Accounts
You may use certain features without an account. Creating an account enables syncing playlists, favorites, and personalized features across devices. You are responsible for maintaining the security of your account and password and must not share your credentials.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behavior, or are used for unauthorized purposes.
4. Subscriptions & Billing
Trending Music offers a free tier with advertisements, plus a Premium subscription that removes ads and unlocks the AI DJ, Right Now playlists, and other Premium features.
- Free trial— New Premium subscribers receive a 7-day free trial on the monthly plan or a 3-day free trial on the weekly plan (offered through the Apple App Store; eligibility is set by Apple). You will not be charged during the trial period. Cancel before the trial ends to avoid charges.
- Recurring billing — After the trial, your subscription renews automatically at the start of each billing period until canceled.
- Cancellation — You may cancel at any time via iPhone Settings → Apple ID → Subscriptions. Access continues through the end of the current billing period.
- Refunds— All payments are processed by Apple. Refund requests must be directed to Apple via reportaproblem.apple.com.
By subscribing, you also agree to Apple's Licensed Application End User License Agreement. Prices may vary by region and are subject to change with notice.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to circumvent access restrictions, rate limits, or Premium gating
- Scrape, crawl, record, or bulk-download content from the Service
- Upload, transmit, or share content that is illegal, hateful, harassing, or harmful
- Impersonate another person or misrepresent your identity
- Interfere with or disrupt the Service or its infrastructure
- Use automated tools (bots, scripts) to interact with the Service without permission
- Resell, redistribute, or commercially exploit the Service or its content
6. User-Generated Content
The Service allows you to create playlists, set a display name, bio, and avatar, and favorite or follow other users when those features are enabled. You retain ownership of content you create, but grant us a non-exclusive, royalty-free license to display and distribute it within the Service.
You are solely responsible for content you submit. We reserve the right to remove content that violates these Terms.
6a. Collaborative Playlists & Live Listening (Jam)
Collaborative playlists and Jam (live listening) sessions are free for every Trending user — no subscription is required to host, join, invite, react with emoji, or use the AI co-pilot suggestions.
How collaboration works
When you create a collaborative playlist, you become the owner. Anyone with the invite link can join, add tracks, and react. Tracks added to a collaborative playlist are visible and playable by every collaborator on that playlist, and the owner may remove tracks, kick collaborators, transfer ownership, or lock the playlist against further additions. When you join a collaborative playlist, you grant other members of that playlist a non-exclusive license to view and play the tracks you have added, within the Service, for as long as the playlist exists.
Identity and the "Anonymous" default
By default, other participants in a collaborative playlist or Jam see your account as "Anonymous" with a colored initial circle derived from your user ID. Your display name and profile photo become visible to other collaborators only if you explicitly enable "Show on collaborative playlists" in your profile settings. You may toggle this setting at any time.
Invite codes
Each collaborative playlist and Jam has an 8-character invite code (e.g. K7M2QXJP) and a shareable URL of the form https://trending.fm/p/CODE. Anyone with the code or URL may join. Treat invite codes like passwords for the playlist or Jam: anyone who has the code can add tracks (collaborative playlists) or appear in the session (Jam). If an invite gets out of hand, the owner can lock the playlist against further additions or end the Jam at any time.
Acceptable use in collaboration
All Acceptable Use rules (Section 5) apply to content added, reactions sent, and display names used in collaborative playlists and Jams. You may not impersonate another user, use another user's photo without permission, or use a display name designed to mislead other participants. We reserve the right to remove content, reactions, or participants that violate these Terms.
Jam sessions are ephemeral
Jam sessions exist only while the host has the session active. Reactions sent during a Jam are short-lived and are not retained as part of any permanent record after the session ends. Jam sessions do not include text or voice chat — only emoji reactions.
7. Music Content & Intellectual Property
Music and video content available through the Service is sourced from third-party providers, primarily YouTube. We do not claim ownership of third-party music content. All copyrights and trademarks remain with their respective owners.
The Trending Music name, logo, app design, recommendation algorithms, and original interface designs are the property of Trending Music, Inc. and are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without written permission.
8. AI DJ, Voice Input, Shazam & Personalization
The Service uses your listening history and preferences to generate personalized content including Daily Mixes, Right Now playlists, and AI DJ sessions. These recommendations are generated algorithmically and use AI-powered services for script generation and content selection.
The AI DJ accepts voice commands through your device's microphone. Speech-to-text is performed on-device using Apple's Speech Recognition framework. The optional DJ narrator uses Apple's text-to-speech framework with scripts generated by our AI service.
The Shazam a Song feature uses Apple's ShazamKit framework to identify songs playing around you via the device's microphone. Audio is processed locally by ShazamKit; the matched song's title and artist are then used to look up a streamable version inside Trending. Free users receive one identification as a free trial; subsequent identifications require a Premium subscription.
AI-generated content (DJ scripts, recommendations) is provided as-is and may occasionally include factual inaccuracies. Use it as a creative aid, not as authoritative information.
9. Privacy & Activity Sharing
Your use of the Service is governed by our Privacy Policy. Key points:
- Listening history is private by default
- Activity sharing (leaderboard visibility, public profile stats) must be explicitly opted into
- You can disable activity sharing at any time in Settings
10. Third-Party Services
The Service integrates with third-party platforms. Your use of these integrations is subject to their respective terms:
- YouTube— Subject to YouTube's Terms of Service
- Apple App Store — Subject to Apple's Licensed Application End User License Agreement
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that all content will always be available.
Music availability may vary based on region and licensing. Songs may be removed or become unavailable without notice when third-party providers (e.g., YouTube) change their catalog.
12. Limitation of Liability
To the maximum extent permitted by law, Trending Music, Inc. and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or service interruptions.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Account Termination
You may delete your account at any time via Settings → Account → Delete Account. We may terminate or suspend your account if you violate these Terms or engage in conduct we reasonably believe is harmful to the Service or other users.
14. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. For material changes, we may notify you via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.
